Terms of Service

1. Who we are

StayCircle (“StayCircle”, “we”, “us”) operates a platform that helps people discover shared accommodation and connect with hosts and flatmates. We are a listing and communication platform. We are not a real estate broker, landlord, tenant or payment processor, and we are not a party to any rental agreement.

2. Eligibility and accounts

• You must be at least 18 years old and legally able to enter into contracts.
• You must provide accurate information and keep it current.
• You are responsible for activity under your account and for keeping your password secure.
• We may require email or phone verification before certain actions, including publishing listings.
• One person or organisation may not maintain duplicate accounts to evade moderation or suspension.

3. Listings and moderation

• Hosts are responsible for the accuracy of rent, deposit, availability, amenities, house rules and photos.
• New and materially edited listings are reviewed before publication. We may approve, request changes, reject, pause or remove any listing.
• Only approved listings appear in public search. Approval is not an endorsement or a guarantee of the property.
• Listings expire if availability is not reconfirmed. Expired listings are hidden from public search.
• You may not post discriminatory, fraudulent, misleading or illegal content, or list a property you are not authorised to advertise.

4. Communication and conduct

• Use in-platform chat and enquiries for initial coordination. Do not harass, threaten, spam or discriminate.
• Do not use the platform to send malware, phishing links or requests for payment outside a verified rental agreement.
• Members can block others and report listings, members or messages. We may suspend accounts that violate these terms.

5. Payments and deposits

StayCircle does not collect rent, deposits, brokerage or maintenance charges. Any payment arrangement is solely between you and the other party. Never pay before visiting the property and verifying the agreement and the recipient. We are not responsible for money transferred outside the platform.

6. Verification badges

A verified badge indicates that a member has verified an email address and a phone number. It is a reachability signal, not a background check, title verification or safety guarantee. Always inspect the property and documents yourself.

7. Intellectual property

You retain ownership of content you upload, and grant us a non-exclusive, worldwide licence to host, display, resize and distribute it for the purpose of operating the platform. You must have the right to upload every photo and description you submit. Do not upload other people’s copyrighted material without permission.

8. Suspension and termination

We may suspend or terminate access if you breach these terms, create risk for other members, or where required by law. You may delete your account at any time from Account & security. On deletion, active listings are archived and personal details are removed, subject to the retention described in our Privacy Policy.

9. Disclaimers

The platform is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that listings are accurate, that members are who they claim to be, or that the service will be uninterrupted.

10. Limitation of liability

To the maximum extent permitted by law, StayCircle will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, rent, deposits or data, arising from your use of the platform. Where liability cannot be excluded, our aggregate liability is limited to the greater of the amount you paid us in the twelve months before the claim or INR 5,000.

11. Changes to these terms

We may update these terms as the product and the law evolve. Material changes will be announced on the platform or by email. Continuing to use the service after the effective date constitutes acceptance.
